• The trailer the “renter”, is renting will be returned in the same condition as what the “renter” have received it in.
• The “renter” is happy with the condition and safety of the trailer they are renting
• The “renter” shall have a valid drivers license relevant to the size of the trailer rented
• The “renter” agrees that in the event of incorrect license details being provided that the signature and details provided by the
“renter” are proof of hire.
• The “renter” acknowledges and warrants that all information provided by it is true and accurate and can be relied upon by the
owner.
• The company (owner of trailer) will not be held liable for any loss or damage of property that has occurred
• The “renter” will report any damage or loss of the trailer to the appropriate person
• The trailer the “renter” is renting will not be knowingly overloaded or misused
• The “renter” assumes all responsibility for any liability, including but not limited to public third party liability, arising from the trailer
during the Hire Period.
• The “renter” must give a non-refundable booking deposit.
• The “renter” is strictly liable for the loss of, or any damage, accidental or otherwise, to the trailer, its equipment, accessories, load in
or on the trailer, and other people and road users, their property and possessions until the trailer is returned to the owner. The loss
the “renter” is liable for includes transport and administrative costs incurred in the recovery of the trailer.
• The owner will not be liable for any loss or damage sustained as a result of any defect the trailer or by implication that the trailer
was available for hire in a particular condition.
• The renter will be held responsible to fix or replace the trailer if anything would happen to it while in the “renters” possession
• Should the renter choose to repair a tyre that was damaged whilst in their possession, themselves, repairs should be made at Tyger Wheel and Tyre in Noordhoek. Proof of repair needs to be provided to Diverse Trailers.
• The renter will be held responsible for loss of income while the trailer is being fixed or replaced if anything would happen to it while
in the “renters” possession
• The “renter” is responsible for all traffic or parking offences as well as any toll charges incurred during the hire period and will pay
any camera fines incurred during the hire period. The owner reserves the right to charge the “renter” an administrative fee of
R250.00 per offence.
• The “renter” agrees to be liable for all the costs incurred by the owner in the recovery of outstanding amounts.
• The deposit is refundable if the trailer is returned with all equipment, plugs, signage and in the same condition as it was received.
• Failure to return the trailer without advising the owner of the late return will incur a hire charge until the trailer is returned calculate
at a rate of R250 – R650 per day (depending on trailer type), or part thereof, plus the additional damage waiver fee, if applicable, to
ensure the overdue hire period enjoys the same level of damage waiver as for the original hire period.
• Late returns not advised as above more than 24 hours after the scheduled return time will be considered as stolen trailers and the
“renter” will be liable to prosecution for theft and all charges associated with recovering the trailer.

Trailer Insurance
• All trailers must be returned by 18h00.
• All confiscated, recovery or repair costs will be payable by the renter of the trailer within 10 days after damage occurred.
• Over load is not permitted and will be charged extra to replace damaged bearings and other damage elements of the trailers.
• Keys and locks are provided and must be returned . If Not the “renter” is responsible for the charges of replacing it .

Domicilium
The “renter” hereby elects its domicilium citandi etc excutandi as the address registered on this contract.

Please note the following:

For any long term rental a booking deposit will be required to hold the trailer for the specific time indicated. This is a non-refundable booking deposit to secure the trailer rental.
